Discrimination in Education

It is illegal for schools and universities to discriminate against individuals based upon race, color, national origin or sex.

Right to Free Appropriate Public Education and IDEA

The Individuals with Disabilities Act (IDEA) guarantees that children with special needs will receive a free appropriate education.  It covers children with medical conditions as well as those with learning disabilities such as autism, dyslexia, ADD and ADHD.  Our attorneys are experienced in working with parents and school districts to negotiate and implement individualized education programs (IEPs).  We are also willing and prepared to litigate on behalf of your child at due process hearings to ensure that your child receives the education they deserve.  If a school district has denied your child rights under IDEA or Section 504 of the Rehabilitation Act, or has not complied with an IEP, you may have a claim for damages.  Contact our office to schedule an appointment and discuss your options.     

School Bullying and Harassment

If your child has been molested or abused by a faculty member, or has been bullied or harassed by other students, we may be able to help.  Title IX of the Civil Rights Act of 1964 protects students from sexual harassment from faculty members and the creation of a hostile education environment by other students, if that hostile environment is based upon the student’s gender or sex.  Likewise, harassment or discrimination based on race, national origin or disability is also prohibited by federal and state law.

Student Expulsion and Discipline

Many schools and universities have recently taken a strong stance against student misconduct and enacted zero tolerance policies.  As a result, the number of disciplinary proceedings has increased.  Our attorneys are experienced in challenging the sufficiency of the grounds for an expulsion, as well as the procedures that were followed by the school district or university in the course of the disciplinary proceedings.
